Ahead of commencement, the Commission has published guidance explaining how a person recorded on body-worn camera footage may request access under Section 4C of the Police Armament and Body-Worn Recording Act 2026, and the limited grounds on which access may be restricted — to protect safety, a child, a victim, a confidential source, an active investigation, legal privilege, or another substantial lawful interest.
The guidance also explains when the Commission may release footage publicly for accountability purposes where proportionate to privacy interests, with redaction or anonymisation applied wherever reasonably practicable, and how routine footage retained for at least 90 days differs from footage preserved for an ongoing investigation or legal proceeding under Section 4B.
